On 21 December 2020, the Hong Kong Competition Commission (“Commission”) filed a case against Linde HKO Limited and Linde GmbH (collectively as “Linde”) for the abuse of substantial degree of market power in the medical gases supply market in Hong Kong causing detriment in the downstream medical gas pipeline system (“MGPS”) maintenance market. The Commission also claims against the General Manager of the relevant division of Linde HKO for his active involvement in the contravention.

The Commission alleges that Linde, by leveraging its de facto monopoly position in the medical gases supply market into the downstream MGPS maintenance market, engaged in various exclusionary acts such as unjustified denial of supply of medical gases necessary for carrying out the MGPS maintenance services and imposition of arbitrary and/or unreasonable trading terms against MGI causing MGI to be unable to compete for MGPS maintenance service contracts.
